Copyright is a set of rights that belong to the author in connection with the creation and use of the work of literature, science and art. The copyright protects the author’s personal non-property and property rights.

  • the right to demand the indication of the author on the work and its copies during any of its public use;
  • the right to prohibit the mention of the author during public use of the work if he as the author of the work wishes to remain anonymous;
  • the right to choose a pseudonym, to indicate and demand the indication of a pseudonym on the work and its copies during any of its public use;
  • the right to demand the preservation of the integrity of the work and to oppose any distortion or other alteration of the work or any other encroachment on it that may damage the honour and reputation of the author.

  • the exclusive right to use the work;
  • the exclusive right on permission or prohibition of the work’s use by other persons.

According to the Law of Ukraine "On Copyright and Related Rights", both registered and unregistered works are protected equally.

The registration of copyright on the work – getting a certificate, which is the only means of confirming their authorship in the сase of its wrongful use by others. The certificate is issued by the Ministry of Economic Development and Trade of Ukraine.

Copyright – copyright sign, which is used to notify the exclusive right on publishing of a specific person or organization, as well as the period of occurrence of such rights.

The Copyright sign consists of a capital Latin letter C, circled (©), the surname and initials of the person or the organization’s title that owns the right on the work, and the year of the first publication of the work.

Open access license is the permission of the copyright holder to use the work in certain ways, the list of which is determined by the license. 

The practice of using Creative Commons licenses is the most common.

Features of open access licenses:

  • giving users the right to further spreading the works (sending them to any person, informing on other websites, etc.);
  • depending on the type of licenses, the possibility of giving to the unlimited number of persons the right to implement: translation and further spreading the work; commercial and non-commercial use of the work; only non-commercial use of the work; creation and further spreading the derivative works.

 

 

Who can license a work under a CC license?

CC licenses can only be given by the author if the author has ownership of his publication or is the holder of the copyright of the work.

If the exclusive right to use the work has been transferred to the publisher, usually the author can not publish the work anymore under the CC license.

In addition, all co-authors, holders of the images, must agree to the licensing.

How can I publish a work under a CC license?

The work is publishing under the CC license, referring to the license in the work. Note that the license link and, if you want, the license logo must be located in a place available to the user (for example, on the title page).

If the work contains only some components with open content (such as an image), a reference to the license should be added to the appropriate component, such as a caption.

The license link should include the name of the license, a stable license URL, and, if you want, the logo of the license.

Can I cancel the licensing of my work under a Creative Commons license?

You cannot revoke a CC license. In addition, "more liberal" CC licenses cannot be subsequently converted to "more limited" CC licenses.
